Galway Personal Injuries List Callover

SITTINGS – Monday 14th October 2024 to Friday 25th October 2024

There will be a Positive Callover of the first 75 cases set down for the Galway Personal Injuries List on Monday the 9th September 2024 on a Hybrid basis before Mr Justice O’ Connor to fix dates for the Sittings commencing the 14th October 2024. As this is a Positive Callover, where there is no Appearance by either party the Notice of Trial may be Struck Out.

There will be provision to call on and adjourn matters further down in the List with the written consent of all parties involved. These applications must be flagged with the Registrar in advance and mentioned at 9.30 on the morning of the Callover. Please see the list for further information.

As noted in the Callover List Mr Justice O’ Connor requires any party attending to be fully briefed in the case and in a position to advise the Court of the required information. When forwarding your Instructions please ensure to provide the following information;

  1. Date of accrual of cause of action in the proceedings;
    2. Expected dates of compliance by all parties with O.39 (46) RSC (inserted by SI 391/1998);
    3. The expected duration of trial;
    4. Whether the hearing will be confined to an assessment of damages only;
    5. Whether VMR facilities for an expert may be required at trial. (The default position unless otherwise sought at the call over is that all evidence at trial will be heard physically in Court)
    6. Details of when and where any outstanding motion in the proceedings is listed so that it may be resolved before or during the sessions. It is intended to hear and determine any pre-sessions motions or further applications on Tuesday 8th October 2024.

If you require us to attend on Counsel or make an application on your behalf you should forward your instructions to reach us no later than 1.00pm on Friday the 6th September 2024. No instructions will be taken on the day of the Callover.
