Cork Personal Injuries List Callover June 14th

SITTINGS – Monday 15th July 2024 to Friday 26th July 2024

A Callover of all cases set down for the Cork Personal Injury List will take place on Friday the 14th June 2024 remotely before Ms Justice Gearty at 10.30am. Please note as per the directions in the Callover where there is no appearance by either side the Notice of Trail may be struck out. The list will be called over until the quota of 120 cases has been reached.

If you require us to attend or make an application on your behalf you should forward your instructions to reach us no later than 1.00pm on Thursday the 13th June 2024. No instructions will be taken on the morning of the callover.

When forwarding instructions please ensure to include all the following information;
 

  1. Title and List Number of the action.
  2. The party for whom you act.
  3. When the matter was set down.
  4. If the application is on Consent of the other parties or on notice. (If on notice please advise the date on which they were notified of the application being made).
  5. If an order is being sought please set out what is to happen with the Costs.

Please note as per previous provincial Callovers, the Court will be reluctant to adjourn matters and a convincing reason for an adjournment will be required regardless of if there is consent.

SITTINGS – Monday 8th July 2024 to Friday 19th July 2024

There will be a Callover of all cases set down for the Dundalk Personal Injuries List on Wednesday the 12th of  June 2024  at 11.00 a.m before Ms Justice Stewart to fix dates for the Sittings commencing the 8th July 2024. Please note as per the notice contained in the List, where there is no Appearance by either party the Notice of Trial may be Struck Out. The Registrar will sit at 10.30 to deal with Consent Orders only.

LIMERICK – SITTING IN ENNIS PERSONAL INJURY CALLOVER ON 14TH MAY 2024

SITTINGS – MONDAY 17TH JUNE TO FRIDAY 28TH JUNE 2024

There will be a Callover of all matters set down for the Limerick Personal Injury List – Sitting in Ennis on Tuesday the 14th May 2024 to fix dates for the sittings in Ennis Courthouse commencing Monday the 17th June 2024.

The Callover List, when published, can be found in the Legal Diary section of the High Court website.

 

 

 

When forwarding your Instructions please ensure to provide the following information;

  1. Date of accrual of cause of action in the proceedings;
    2. Expected dates of compliance by all parties with O.39 (46) RSC (inserted by SI 391/1998);
    3. The expected duration of trial;
    4. Whether the hearing will be confined to an assessment of damages only;
    5. Whether VMR facilities for an expert may be required at trial. (The default position unless otherwise sought at the call over is that all evidence at trial will be heard physically in Court)
    6. Details of when and where any outstanding motion in the proceedings is listed so that it may be resolved before or during the sessions. It is intended to hear and determine any pre-sessions motions or further applications on Tuesday 30th May 2024.

There will be a Positive callover of all cases set down for the Galway Personal Injuries List on Friday the 10th May 2024 on a Hybrid basis at 2 pm before Mr Justice O’Connor to fix dates for the Sittings commencing the 24th June 2024. As this is a Positive callover, where there is no Appearance by either party the Notice of Trial may be Struck Out. No applications for Consent adjournments will be taken by the Registrar.

Limerick Personal Injuries Supplemental List

There will be a callover of all cases listed in the Limerick Supplemental List on Friday the 3rd May 2024 at 2pm before Mr Justice O’ Connor.

The cases in this list will be transferred to the Dublin Personal Injury list unless an application to either strike out or call on the case is made at the callover on the 3rd.

If the matter is ready to be called on for the upcoming sessions sitting in Ennis the parties must confirm that all the requirements of Order 39 RSC have been fulfilled. If Order 39 has not been complied with in full the matter cannot be called on at the upcoming sessions.

As this is a Positive callover, where there is no Appearance by either party the Notice of Trial will be Struck Out. The Registrar will sit at 9.30 to deal with any matters that can be dealt with on Consent including calling matters on for hearing on consent.

Ms Justice Stack requires any party attending to be fully briefed in the case and in a position to advise the Court of the required information. When sending instructions please provide the following information;

  • Date of accrual of cause of action
  • Date of compliance by all parties with SI 391/1998
  • Duration of Trail
  • If the matter is assessment only
  • If VMR facilities will be required at the trial
  • If the other side were put on notice of the application, please provide the date notice was given
  • If an application to adjourn on consent is to be made please provide a detailed reason

As this is a Positive callover, where there is no Appearance by either party the Notice of Trial will be Struck Out. No applications for Consent adjournments will be taken by the Registrar.

As noted in the Callover List Mr Justice O’ Connor requires any party attending to be fully briefed in the case and in a position to advise the Court of the required information. For this reason we will only be in a position to deal with the following applications at the Callover;
