Re: Galway Personal Injuries List, (Sittings Monday 24th February 2025 to Friday 7th March 2025)

The Galway Personal Injuries Callover which was postponed due to the Red Weather Warning will now take place on Thursday the 30th January 2025 before Mr Justice O’ Connor.

Please note in order to make any application we will require ALL of the below information;
- Date of accrual of cause of action in the proceedings;
2. Expected dates of compliance by all parties with O.39 (46) RSC (inserted by SI 391/1998);
3. The expected duration of trial;
4. Whether the hearing will be confined to an assessment of damages only;
5. Whether VMR facilities for an expert may be required at trial. (The default position unless otherwise sought at the call over is that all evidence at trial will be heard physically in Court)
6. Details of when and where any outstanding motion in the proceedings is listed so that it may be resolved before or during the sessions.
If you require us to attend on Counsel or make an application on your behalf you should forward your instructions to reach us no later than 1.00pm on Wednesday the 29th January 2025. No instructions will be taken on the morning of the Callover.

Going forward, there is no requirement to lodge Books in advance in the List Room. Books are now required to be physically brought to the Court on the day and need to be handed into the Registrar when the matter is called.
The last day of the 2024 Michaelmas court term was also sadly the day that former member of the Pearts team, Brian Clifford aged 41, lost his long, brave battle with cancer. Husband to Caroline Wade, the eldest daughter of our Principal Valerie Peart and Gerard Wade and brother-in-law of Niamh, John and Jennifer Wade, (wife of our Office manager James Clarke), Brian will be significantly missed by all who knew and loved him. Leaving behind three small children, Daniel (11), Lucie (9) and Sam (3), it is hard to put into words how heartbreaking the reality of this new norm is for them.
There will be a Positive callover of cases set down for the Limerick Personal Injuries List on Thursday the 16th January 2025 on a Hybrid basis at 11.00 O’ Clock before Mr Justice O’ Connor to fix dates for the Sittings commencing the 10th February 2025. As this is a Positive callover, where there is no Appearance by either party the Notice of Trial may be Struck Out.

As with all previous Callovers, where there is no Appearance by either party the Notice of Trial may be Struck Out. The List will be held on a Hybrid basis with the Courtroom to be confirmed and the Registrar will sit at 11.00 am to deal with Consent applications.
