VP Becomes JVP

50 years working in Pearts and recently appointed as Junior Vice President of the Law Society of Ireland, 2024 is certainly a landmark year for our Principal, Valerie Peart.

While never one to hog the limelight, as Valerie just gets on with it, we feel it’s only appropriate to congratulate her on this incredible achievement.

From her college days working with her Father, Denis, to assisting the business during her brother, Michael’s time at the helm, (while also running her busy private practice and rearing four children), to her full time takeover in 2002 with her husband Gerard Wade, Valerie has certainly not been idle.

The decision to run for election to the Law Society Council in 2009, as she says herself, “was possibly one of the best decisions of my professional life.”

We asked Valerie how she felt about her latest appointment:

I look forward to working with our President, Eamonn Harrington and Senior Vice President, Rosemarie Loftus and the amazing team at The Law Society, under the stewardship of Mark Garrett, the Director General.

As Junior Vice President, I am committed to serving the Society in any way I can and I look forward to a productive and busy year.”

There will be a Positive Callover of all cases set down for the Dundalk Personal Injuries List on Wednesday the 6th November 2024 at 11.00 a.m before Ms Justice Stewart to fix dates for the Sittings commencing the 2nd December 2024.

Please note as per the notice contained in the List, where there is no Appearance by either party the Notice of Trial may be Struck Out. The Registrar will sit at 10.30 to deal with Consent Orders only.

Callover of Matters Set Down for the Sligo Personal Injuries List Sittings (Monday 25th November 2024 to Friday 6th December 2024)

A Callover of matters set down for the Sligo Personal Injuries List will take place on Thursday the 24th October 2024 at 12.00 noon before Mr. Justice Jordan to fix dates for the Sittings commencing the 25th November 2024. As with all previous Callovers, where there is no Appearance by either party the Notice of Trial may be Struck Out. The List will be held on a Hybrid basis with the Courtroom to be confirmed and the Registrar will sit at 11.00 am to deal with Consent applications.

There will be a Positive Callover of cases set down for the Limerick Personal Injuries List on Thursday the 17th October 2024 on a Hybrid basis at 12.00 O’ Clock before Mr Justice Barr to fix dates for the Sittings commencing the 11th November 2024.

As this is a Positive Callover, where there is no Appearance by either party the Notice of Trial may be Struck Out. The Registrar will sit at 11.00 am to deal with Consent Orders only, no applications for Consent adjournments will be taken by the Registrar.

Fundraising of the Tastiest Kind

Bakers and baristas were out in force for the Bewleys Big Coffee Morning in aid of Our Lady’s Hospice & Care Services, Harold’s Cross, Blackrock & Wicklow and Together for Hospice. 

An amazing array of treats filled the kitchen with generous donations being made to this important cause. This cause is close to many of the staff members hearts with today hitting harder as former Pearts team member Brian, who is also the son-in-law of Valerie & Gerard and brother-in-law of Niamh, is currently under the care of the superb staff in Harold’s Cross Hospice.

Cork Personal Injuries List Callover, (Sittings Monday 7th October 2024 to Friday 18th October 2024)

There will be a callover of the Cork Personal Injuries List on Thursday the 19th September 2024 and Pearts will be attending. The callover will be on a Hybrid basis before Ms Justice Stack to fix dates for the Sittings commencing the 7th October 2024. The list will be called until the required quota of 120 cases has been reached, where there is no Appearance by either party the Notice of Trial may be Struck Out.

The default position will be that all cases will be afforded a physical hearing; however, personal injuries actions may be heard fully remotely or as a hybrid hearing where the parties agree or by direction of the Court.

Galway Personal Injuries List Callover

SITTINGS – Monday 14th October 2024 to Friday 25th October 2024

There will be a Positive Callover of the first 75 cases set down for the Galway Personal Injuries List on Monday the 9th September 2024 on a Hybrid basis before Mr Justice O’ Connor to fix dates for the Sittings commencing the 14th October 2024. As this is a Positive Callover, where there is no Appearance by either party the Notice of Trial may be Struck Out.

There will be provision to call on and adjourn matters further down in the List with the written consent of all parties involved. These applications must be flagged with the Registrar in advance and mentioned at 9.30 on the morning of the Callover. Please see the list for further information.

As noted in the Callover List Mr Justice O’ Connor requires any party attending to be fully briefed in the case and in a position to advise the Court of the required information. When forwarding your Instructions please ensure to provide the following information;

  1. Date of accrual of cause of action in the proceedings;
    2. Expected dates of compliance by all parties with O.39 (46) RSC (inserted by SI 391/1998);
    3. The expected duration of trial;
    4. Whether the hearing will be confined to an assessment of damages only;
    5. Whether VMR facilities for an expert may be required at trial. (The default position unless otherwise sought at the call over is that all evidence at trial will be heard physically in Court)
    6. Details of when and where any outstanding motion in the proceedings is listed so that it may be resolved before or during the sessions. It is intended to hear and determine any pre-sessions motions or further applications on Tuesday 8th October 2024.

If you require us to attend on Counsel or make an application on your behalf you should forward your instructions to reach us no later than 1.00pm on Friday the 6th September 2024. No instructions will be taken on the day of the Callover.

Awarding Work

James Clarke and Niamh Wade added to the glitz and glamour which engulfed the Convention Centre Dublin on June 14th for the Irish Law Awards. Unfortunately they didn’t enter the spotlight to claim the trophy for the ‘Service Provider to the Legal Profession’, but it was fantastic to be able to clap and cheer for so many of our well-deserving colleagues and customers who did win.

Cork Personal Injuries List Callover June 14th

SITTINGS – Monday 15th July 2024 to Friday 26th July 2024

A Callover of all cases set down for the Cork Personal Injury List will take place on Friday the 14th June 2024 remotely before Ms Justice Gearty at 10.30am. Please note as per the directions in the Callover where there is no appearance by either side the Notice of Trail may be struck out. The list will be called over until the quota of 120 cases has been reached.

If you require us to attend or make an application on your behalf you should forward your instructions to reach us no later than 1.00pm on Thursday the 13th June 2024. No instructions will be taken on the morning of the callover.

  1. Title and List Number of the action.
  2. The party for whom you act.
  3. When the matter was set down.
  4. If the application is on Consent of the other parties or on notice. (If on notice please advise the date on which they were notified of the application being made).
